Terms of Service

The Service is designed for children aged roughly 3–10, but accounts may only be created and operated by a parent or legal guardian who is at least 18 (or the age of majority where you live). You are responsible for setting up profiles, supervising your child's use, and for all activity under your account. By using the Service you confirm that you are the child's parent or guardian and that you consent to your child using it.

Keep your login details and parent PIN confidential, and tell us promptly of any unauthorised use. For security we limit the number of devices that can be signed in to an account; you can manage your devices in the app.

Sketchopia lets a child draw on a canvas and uses artificial intelligence to turn the drawing into a game, an animated story, or a learning activity. Features, content and limits may change as we improve the Service. AI-generated content is created automatically and may occasionally be imperfect or inaccurate; it is intended for fun and learning, not as a factual, medical, or professional reference.

Full access to Sketchopia is available through an auto-renewing subscription that begins with a 7-day free trial. Some features may also be available at no charge.

• Billing. Subscriptions are sold and processed by the app store for your platform (the Apple App Store or Google Play) under their terms. Prices are shown in the app in your local currency before you buy.
• Free trial & auto-renewal. If you start a 7-day free trial, you are not charged during the trial. Unless you cancel at least 24 hours before the trial ends, the subscription automatically renews and your store account is charged the displayed price for each period, and it keeps renewing until you cancel.
• Cancelling. You can cancel any time from your Apple App Store or Google Play account settings; cancellation takes effect at the end of the current billing period. Deleting the app does not cancel a subscription.
• Refunds. Payments are handled by the stores and our processor and are subject to their refund policies, as well as to any non-waivable refund or cancellation rights you have under the consumer laws of your country.
• Price changes. We may change prices. We will give notice as required and, where the law requires, ask for your consent before renewing at a new price.

Use the Service only for its intended personal, non-commercial, family use. You agree not to misuse it, attempt to disrupt or overload it, reverse engineer it (except where the law allows), resell or commercially exploit it, or use it to create or share unlawful or harmful content. Please help your child use the drawing and voice features appropriately.

Your child's drawings and creations belong to you and your child. To run the Service, you grant us a limited, worldwide, royalty-free licence to host, store, process, display and adapt that content solely to operate and provide the Service to you — for example, sending a drawing to our AI provider to generate a game or lesson, and saving creations to your child's gallery. We do not claim ownership of your child's drawings and we do not use them for advertising.

Sketchopia itself — including the app, website, games, characters, look and feel, software and the content we provide — is owned by Trishula Gamings Private Limited and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service; you may not copy or exploit it except as these Terms allow.

The Service relies on third parties, including the app stores, Anthropic, RevenueCat, Supabase and our hosting providers. Your use of the app stores and any purchases you make through them are also governed by those parties' terms.

Sketchopia is an educational and entertainment tool, not a substitute for parental supervision or professional educational advice. The Service is provided "as is" and "as available", and, to the extent permitted by law, we disclaim implied warranties. Nothing here excludes any rights you have under mandatory consumer protection law.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, for fraud, or for your non-waivable consumer rights). Where our liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim arose.

You can stop using the Service and delete your account at any time (Parent dashboard → Delete Account). We may suspend or end your access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive — including those on intellectual property, disclaimers and limitation of liability — continue to apply after termination.

These Terms are governed by the laws of India, and the courts of New Delhi, India have jurisdiction over any dispute — except that, if you are a consumer, you also keep the benefit of any mandatory consumer protections of your country of residence and any right you have under local law to bring proceedings in your own country's courts.

We may update these Terms from time to time. We will post the updated version here with a new "Effective" date and, for material changes, notify you where required. Continuing to use the Service after changes take effect means you accept the updated Terms.
